Welcome to Saymo! By using our app and services, you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, do not use Saymo.
1. Acceptance of Terms
By accessing or using Saymo, you confirm that you are at least 13 years old (or the minimum age required in your country), and that you agree to comply with these Terms and all applicable laws and regulations.
- If you are under 18, your profile and certain features may be set to private by default to protect your privacy. You can change these settings in your profile. We take additional measures to protect minors as required by law.
2. Account Registration & Security
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use or security breach.
2A. Personalization
Saymo is a personalized social platform. By using Saymo, you agree that your experience (including feed, recommendations, push notifications, and content shown to you) will be personalized based on your activity, location, and interests. Personalization is a core feature of the service.
3. User Content
- You retain ownership of the audio posts, comments, and other content you create (“User Content”).
- By uploading content, you grant Saymo and its affiliates a worldwide, royalty-free, sublicensable, transferable, irrevocable license to use, reproduce, distribute, display, perform, adapt, modify, create derivative works, analyze, promote, and improve the service in any media formats or channels, for any purpose related to Saymo's operation and development.
- You are solely responsible for your content and its compliance with these Terms and all applicable laws.
- When you create a post, your IP address and the country (determined by your IP or coordinates) are stored with your post and may be used for recommendations, analytics, and security.
- Public content (including posts, comments, and profile information) may be used by Saymo for promotion, marketing, analytics, or shared with partners, always in accordance with your privacy rights and applicable law.
4. Acceptable Use
You agree not to use Saymo to:
- Post, share, or transmit any content that is illegal, harmful, abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your affiliation.
- Post content that infringes on intellectual property, privacy, or other rights of others.
- Upload viruses, malware, or any code designed to disrupt or damage the service.
- Use automated scripts, bots, or scraping tools.
- Harass, threaten, or bully other users.
- Collect or store personal data about other users without their consent.
- Circumvent or attempt to circumvent any security or moderation features.
4A. Hashtag Use Policy
You may not use hashtags for advertising, offensive content, hate speech, political promotion, or any other purpose that violates these Terms or applicable law. Saymo reserves the right to remove or restrict any hashtags at its sole discretion.
4B. Disclaimer for User Content
Saymo is not responsible for any content posted by users. You may encounter content that is inaccurate, offensive, inappropriate, or otherwise objectionable. You use the service at your own risk.
5. Voice Content Guidelines
- Audio posts and comments must comply with all applicable laws and these Terms.
- Do not post audio containing hate speech, threats, explicit content, or personal attacks.
- Do not use Saymo to spread misinformation, spam, or promotional content without permission.
- Respect the privacy of others; do not record or share private conversations without consent.
6. Community & Moderation
- Saymo uses automated and manual moderation to maintain a safe environment.
- We reserve the right to remove any content or suspend accounts that violate these Terms, at our sole discretion.
- Users can report inappropriate content or behavior via in-app tools.
- Repeated or severe violations may result in permanent account suspension.
7. Premium Features, In-App Purchases & Virtual Currency
- Some features (e.g., longer audio posts, analytics, badges) are available only to Premium users.
- All purchases of Saymo Premium, Saymos (virtual currency), or other in-app items are final and non-refundable, except as required by law or app store policy.
- Saymos (virtual currency) cannot be transferred, gifted, or sold to other users.
- The contents of the Premium package and its price may change at any time without prior notice or user consent.
- We reserve the right to add, remove, or modify Premium features at our discretion.
- You may gift Premium to other users. Gift transactions are recorded and may include information about the giver, recipient, date, status, and payment provider. Gifts are non-refundable.
- Purchases of Saymos and Premium are processed via third-party payment providers (e.g., Stripe, Apple, Google). Transaction data is stored for compliance and analytics.
8. Promo, Advertising & Sponsored Content
- Users may launch Promo campaigns to promote their posts in the feed. Other users cannot opt out of seeing promoted posts in their feed.
- Saymo is building its own advertising network. Ads and sponsored content may appear in your feed.
- We do not share your personal data with third-party advertisers.
- All advertising is managed and delivered by Saymo. You may see ads or sponsored posts as part of your experience.
- Promo campaigns are non-refundable. Campaign details (budget, target countries, analytics, status) are stored and may be shared with payment providers for processing.
- Saymo reserves the right to reject, suspend, or terminate any promo campaign at its discretion.
9. Brand Usernames & Intellectual Property
- If you register a username that matches a brand, trademark, or company to which you do not have rights, Saymo reserves the right to reclaim or change your username at any time, without compensation.
- If you are a brand owner and wish to claim a username, please contact support at [email protected].
- All Saymo trademarks, logos, and service marks are the property of Saymo or its licensors. You may not use our branding without written permission.
10. Privacy & GDPR
- Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.
- If you are located in the European Union or EEA, you have rights under the General Data Protection Regulation (GDPR), including the right to access, correct, delete, or restrict the processing of your personal data. To exercise these rights, contact us at [email protected].
- We process your data lawfully, fairly, and transparently, and only for the purposes described in our Privacy Policy.
- By using Saymo, you consent to the collection and use of your IP address and location data for recommendations, security, and analytics.
- Your country is determined by your IP address or coordinates and is used to personalize your feed and recommendations.
- Your country (determined by IP) is cached for up to 24 hours to optimize performance.
- We use third-party services (such as ipinfo.io, Google Maps API, Firebase, Google Analytics) for location enrichment, analytics, and push notifications.
11. DMCA & Copyright
- If you believe your copyright or intellectual property rights have been infringed on Saymo, please send a detailed notice to [email protected] with the subject "DMCA Notice".
- We will respond to all valid DMCA requests and may remove or disable access to infringing content.
12. Children's Policy
- Saymo is not intended for children under 13 (or the minimum age required in your country).
- If we become aware that a child under 13 has created an account, we will take steps to remove the account and associated data.
- Parents or guardians who believe their child has provided us with personal information may contact us at [email protected].
13. Push Notifications, Location & Personalization
- By using Saymo, you consent to receive push notifications and allow access to your device's microphone and (optionally) location, as required for core features.
- You can manage permissions in your device settings.
- Push notifications may include personalized recommendations based on your country or activity.
- Your feed is personalized based on your current country (determined by your IP address) and your subscriptions.
- If you use Voice Map or map features, your coordinates, country, and IP are stored with each pin/post. Map display and location enrichment use third-party services (e.g., Google Maps API).
- Abuse of map features (e.g., fake pins) may result in account suspension.
14. Termination
- You may delete your account at any time via the app.
- We may suspend or terminate your access to Saymo at any time, with or without notice, for any violation of these Terms or for any other reason.
15. Disclaimers & Limitation of Liability
- Saymo is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service.
- We are not liable for any damages resulting from your use of Saymo, except as required by law.
15A. Arbitration and Class Action Waiver (for U.S. Residents)
If you are a resident of the United States, you and Saymo agree that all claims or disputes will be resolved through binding arbitration on an individual basis. You waive the right to participate in a class action. Details of the arbitration process will be provided upon request.
16. Changes to Terms
- We may update these Terms from time to time. The latest version will always be available in the app and on our website.
- Continued use of Saymo after changes means you accept the new Terms.
16A. Restrictions in Sanctioned Countries
Saymo may restrict or prohibit access to the service, in whole or in part, in countries or regions subject to international sanctions or where required by law. Use of Saymo in such jurisdictions is not permitted.
16B. Updates to Terms
We may revise these Terms from time to time. The most current version will always be available in the app and on our website. We will provide reasonable advance notice of material changes. Continued use of Saymo after changes means you accept the new Terms.
16C. Entire Agreement, Assignment, No Waiver
These Terms, together with the Privacy Policy and any other agreements you may enter into with Saymo, constitute the entire agreement between you and Saymo. Saymo may assign its rights and obligations under these Terms at any time. Failure to enforce any right or provision does not constitute a waiver of such right or provision.
